Workers’ Compensation
At McKinley, Stults & Aemisegger, LLC, we handle the workers’ compensation needs for employers of all sizes. We assist with implementing policies and procedures to effectively manage workers’ compensation matters that are consistent with our clients’ business objectives. This includes, but is not limited to, workers’ compensation policy development, practice implementation, return-to-work strategies, and developing Drug Free Workplace Act policies that correspond with the workers’ compensation goals and programs. We also assist with self-insured and BWC compliance and premium matters.
In addition, we counsel clients on claims management and exposure analyses. We defend clients on all workers’ compensation matters before the Ohio Bureau of Workers’ Compensation, Industrial Commission, and all courts and courts of appeals. These include matters involving claim allowance, additional conditions, extent of disability, treatment, permanent total disability (PTD), violations of specific safety requirements (VSSRs), fraud, and intentional torts. Our attorneys have successfully represented employers in numerous high profile, multimillion-dollar cases.
In addition to representing clients with their workers’ compensation matters, we also counsel and represent clients with OSHA investigations and litigation. In order to remain compliant with everchanging updates in the law, and to proactively defend against liability and hone in on defense strategies, we regularly provide our clients with training and seminars on various workers’ compensation and OSHA-related topics.
Labor and Employment
At McKinley, Stults & Aemisegger, LLC, we assist employers with their human resources and employment needs. Our services include drafting employee handbooks, handling performance and discipline issues, navigating reductions-in-force, and keeping our clients up to date and compliant with developments in the law.
In addition, we represent employers with employment-related claims, including handling EEOC and OCRC charges, claims of discrimination and wrongful termination, as well as non-compete and other employment contract issues. We also represent unionized employers with their labor matters, including negotiating collective-bargaining agreements, defending against Unfair Labor Practice violations, and handling grievance and arbitration hearings and appeals. We offer training on various employment-related issues and provide seminars on legal updates as well.

If a matter cannot be resolved to our client’s satisfaction, we aggressively defend our clients in court with bench and jury trials, and if necessary, the courts of appeals—all in an efficient and effective manner.
